Terms and Conditions of Sale

These Terms and Conditions of Sale govern the purchase of products made remotely through the website fisogioielli.com, in compliance with Legislative Decree 206/2005 (Consumer Code) and Legislative Decree 70/2003 (Electronic Commerce).

2. Subject Matter
These conditions apply to the sale of fashion jewelry products (925 sterling silver, 14K/18K gold-plated recycled brass, natural freshwater pearls, crystals) through the website fisogioielli.com. Purchases are reserved for adults with legal capacity.
3. Conclusion of the Contract
The purchase contract is considered concluded when:
- The Customer selects one or more products and adds them to the cart
- Fills in the shipping and billing details
- Confirms payment via one of the available methods
- Receives an order confirmation email from FISÒ Gioielli
The order confirmation email constitutes acceptance of the contract.
FISÒ Gioielli reserves the right to refuse orders in case of product unavailability, obvious errors in published prices, or suspected fraud. In such cases, the Customer will be notified via email, and any payment made will be fully refunded.
4. Prices and Payments
Prices indicated on the website are in Euros and are inclusive of VAT (22%) for the final consumer.
Prices do not include shipping costs, which are indicated at checkout based on destination and order amount.

- Klarna / Scalapay (payment in 3 interest-free installments)
Payments are managed by certified providers that apply the highest security standards (PCI DSS). FISÒ Gioielli does not store credit card data.

Summary:
- Italy: 5-7 business days — €4.90 (free over €49)
- EU: 7-10 business days — €9.90 (free over €79)
The risk of loss/damage during transit is borne by FISÒ Gioielli until delivery to the Customer.
6. Right of Withdrawal
Pursuant to articles 52 et seq. of the Consumer Code, the consumer Customer has the right to withdraw from the contract within 14 days of receiving the goods, without any reason.

Exclusions from the right of withdrawal (art. 59 Legislative Decree 206/2005)
- Products personalized with engraving of names, initials, symbols, or other customizations requested by the Customer
- Sealed products not returnable for hygienic or health reasons, if opened after delivery
7. Legal Guarantee of Conformity
All FISÒ Gioielli products benefit from the 24-month legal guarantee of conformity provided by articles 128 et seq. of the Consumer Code for consumers (Legislative Decree 170/2021).
In case of conformity defects, the Customer has the right to:
- Free repair or replacement of the product
- Alternatively: price reduction or contract termination with refund
To activate the warranty: write to info@fisogioielli.com attaching photos of the defect and the order number.
Warranty Exclusions
- Damage caused by improper use or non-compliance with care instructions
- Normal wear and tear of plating due to contact with aggressive substances (chlorine, direct perfumes, detergents)
- Defects appearing beyond the legal terms
Additional Commercial Warranty
FISÒ Gioielli offers a 12-month commercial warranty on 14K/18K gold plating under normal use conditions, except for deterioration caused by contact with aggressive substances (chlorine, direct perfumes, detergents).
8. Liability
FISÒ Gioielli is not responsible for:
- Delivery delays due to force majeure (strikes, weather events, pandemics, customs restrictions)
- Inaccuracies provided by the Customer during the order phase (incorrect address, incomplete data)
- Improper use of the product by the Customer
The maximum liability of FISÒ Gioielli towards the Customer is limited to the value of the order.
9. Applicable Law and Competent Court
This contract is governed by Italian law. For disputes with consumers, the competent court is that of the consumer's residence/domicile (art. 66 bis Consumer Code).
Alternatively, the consumer can activate the alternative dispute resolution (ADR) procedure or use the European Commission's ODR platform: ec.europa.eu/consumers/odr.
10. Amendments
FISÒ Gioielli reserves the right to modify these Terms at any time. Changes do not have retroactive effect on orders already confirmed.
